Terms and Conditions Free Web Vulnerability ScanThis agreement governs the Web Security Audit service provided by Acunetix Ltd. You duly authorise Acunetix to conduct the free security audit on behalf of Abraxax BV. The scan results will be sent to you and to Abraxax BV. By clicking on the Accept button at the bottom of this form, you accept this agreement and agree to be legally bound by it. 1. Application 2. Scope 3. Customer Responsibilities 3.2 The Customers contact person will provide any relevant infrastructure and network data & operating system information required for the Acunetix Web Security Audit to Acunetix Ltd. 3.3 Responsibility to ensure that all necessary and appropriate disaster recovery systems and methods (such as backup, restore and archival) are in place and are functioning properly prior to the Acunetix Web Security Audit Service, lies solely in the hands of Customer personnel. Customer is obliged to agree to perform suitable backups on a regular basis prior to Acunetix Ltd. providing the Acunetix Web Security Audit Service. 4. Customer Acknowledgement 4.2 Customer recognizes that providing thorough back-up of data and software is essential to prevent risks associated with the use of computer products: loss, damage, corruption or mis-transmission of stored data on the web site. 5. No guarantee of accuracy 6. Results 7. Warranty 8. ACUNETIX LTD and ABRAXAX BV DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OR CONDITIONS OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE ACUNETIX WEB SECURITY AUDIT SERVICE. 9. Limitations on Liability and Damages 9.2 Acunetix Ltd and Abraxax will hold no liability for any damage that might result from this test, any way, direct or indirect. 9.3 The limitations on and exclusion of liability for damages set forth above apply regardless of whether the liability is based on breach of contract, tort (including negligence), strict liability, breach of warranties, or any other legal theory. |
